General Terms and Conditions of Sale (T&Cs)
1. Scope of Application
These General Terms and Conditions of Sale ("T&Cs") apply to all sales concluded by Barcino (EURL) via the website (www.barcino.fr), for both individual consumers and business clients, subject to the specific provisions set out below.

2. Products
The essential characteristics of the products are presented on the site. Photographs are for illustrative purposes only and are not contractually binding. Offers are valid while stocks last. If a product becomes unavailable after an order is placed, the customer will be promptly informed and refunded within 14 days.
Coffee-specific advice: our coffees are delivered fresh and should be stored in a cool, dry place, and consumed within the optimal freshness period indicated on the packaging.
3. Orders
An order is confirmed once the following steps are completed: product selection, cart validation, and payment in full. A confirmation email is sent to the customer.
Barcino reserves the right to cancel any order in the event of a prior dispute or non-payment.
4. Prices
Prices are shown in euros, including all taxes (TTC). Delivery charges are indicated before the order is confirmed. Barcino reserves the right to change its prices at any time, but products are invoiced at the price in effect at the time the order is placed.
5. Payment
Payment is due immediately upon placing the order.
6. Delivery
Products are delivered within mainland France and Europe. Delivery times are estimates only.
Risk of loss or damage transfers to the customer upon receipt.
The customer is asked to check the condition of the parcel upon receipt. In the event of an anomaly (damaged or opened parcel, missing product), a formal reservation must be recorded with the carrier, and Barcino must be notified promptly at: ciao@barcino.fr.
Force majeure: Barcino cannot be held liable for delays caused by events beyond its control (strikes, severe weather, carrier issues, etc.).
7. Right of Withdrawal
In accordance with the French Consumer Code, the customer has 14 days from receipt to exercise their right of withdrawal.
The product must be returned complete, unopened, and in perfect condition.
Food exception: opened coffee or perishable products cannot be returned or refunded.
Return shipping costs are the customer's responsibility.
8. Barcino Referral Program
The Barcino referral program allows a site customer (the "Referrer") to recommend the products offered on the site to a person of their choice (the "Referee"), under the following terms.
Conditions applicable to the Referrer — The referral code is personal, not name-restricted, and may be freely shared by the Referrer with third parties. The Referrer may not use their own code to obtain a personal benefit; self-referral is strictly prohibited. For each valid first order placed by a Referee using the code, the Referrer receives Barcino credit, the amount of which is indicated on the site at the time of the current offer. Credits are cumulative.
Conditions applicable to the Referee — The program is exclusively reserved for new customers who have never placed an order on the site. The benefit applies only to the first order, placed using a valid code, for a minimum amount of €49 including tax, excluding delivery costs. A given Referee may only benefit from the program once, regardless of the number of codes received.
Granting and use of credit — Credit is granted only after the Referee's order has been definitively confirmed (payment in full, no cancellation, no full or partial refund). It is automatically deducted upon use, may only be used on the Barcino website, is non-refundable, cannot be exchanged for cash, and cannot be transferred to a third party; it may be used only once, up to the available amount. Any unused balance is forfeited, with no refund or carry-over possible.
Limitations and exclusions — The program cannot be combined with other offers, unless expressly stated otherwise. Barcino reserves the right to suspend, refuse, cancel, or withdraw any benefit in the event of fraud, abuse, self-referral, multiple accounts, false identity, or non-compliance with these T&Cs.
Modification or discontinuation of the program — Barcino reserves the right to modify, suspend, or terminate the program at any time. Any modification will not affect credits validly earned prior to its effective date.
9. Business Clients
These T&Cs also apply to business clients, subject to the following specific provisions:
No right of withdrawal: business clients do not benefit from the 14-day withdrawal period provided for individual consumers.
Warranty and liability: the warranty applies only to defects identified at delivery. Business clients are responsible for the proper storage and use of the products. Barcino's liability is limited to the amount of the order.
Competent jurisdiction: any dispute with a business client falls exclusively under the jurisdiction of the Marseille Commercial Court (Tribunal de commerce de Marseille).
Payment and delivery terms: terms may differ from those applied to individual consumers (timelines, carrier, invoicing).
10. Legal Warranties
The customer benefits from the legal warranty of conformity (2 years from delivery of the goods — Articles L217-3 et seq. of the French Consumer Code), and the warranty against hidden defects (2 years from discovery of the defect — Articles 1641 et seq. of the French Civil Code). In the event of a defective product, Barcino will proceed with a replacement or refund.
11. Liability
Barcino cannot be held liable for: improper storage of coffee, non-compliant use of the products, force majeure events, or delays attributable to the carrier. Barcino's liability is limited to the amount of the order.
12. Intellectual Property
All elements of the Barcino website (text, visuals, logo, design, content) are protected by intellectual property law. Any reproduction or use without authorization is prohibited.
13. Personal Data
In accordance with the French "Informatique et Libertés" law, customers may access, rectify, or delete their data via: ciao@barcinocafe.fr
14. Consumer Mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, every consumer has the right to freely refer, free of charge, to a consumer mediator for the amicable resolution of a dispute with Barcino.
After sending a prior written complaint to Barcino and in the absence of a satisfactory resolution of the dispute, the customer may refer the matter to the mediator with which Barcino is registered:

15. Applicable Law
These T&Cs are governed by French law. In the event of a dispute, the French courts shall have jurisdiction.
